Terms and Conditions
Website: https://yafnah.com Last Updated: 24 September 2026 Location: United Arab Emirates, Abu Dhabi
1. Introduction
These Terms and Conditions ("Terms," "Agreement") constitute a legally binding agreement between you ("Client," "you") and Yafnah and Co, holder of UAE trade licence no. 6616296 ("we," "us," "our," "the Company") governing your use of our website and your booking of the hospitality services we provide. By submitting a booking, making a payment, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, without modification, save as expressly agreed in writing by an authorized representative of the Company.
2. Our Services
We provide, subject to availability and the specific scope agreed in your booking confirmation:
- Hospitality packages — complete Arabic hospitality for private occasions, priced by guest count and including the hospitality crew, the selected hot and cold beverages, live cooking, and all serving equipment.
- Condolence majlis hospitality — hospitality and crew for a condolence majlis, arranged by telephone or WhatsApp rather than through the website, and charged per crew member rather than by package.
- Corporate hospitality — working lunches, meeting receptions, launches and stands, and delegation and VIP hospitality, priced per attendee.
- Hospitality boxes — prepared food delivered ready to serve, without crew or setup.
- Live cooking — cooks preparing Emirati and regional dishes in front of guests on site.
- Hospitality crew ("Staff") — uniformed coffee servers and service personnel. The men's majlis and the women's majlis are served separately, by male and female crew respectively.
The Company reserves the right, at its sole discretion, to substitute personnel of comparable skill and experience where the originally assigned Staff member becomes unavailable for any reason, without this constituting a breach of these Terms.
3. Booking and Reservations
- Bookings may be made via the website at https://yafnah.com, by WhatsApp or telephone on +971 52 326 2018, or by email to [email protected], and shall not be deemed accepted by the Company until a written confirmation is issued.
- A booking is confirmed only upon receipt of a deposit of fifty per cent (50%) of the total.
- The Company requires a minimum of forty-eight (48) hours notice for any booking. Requests inside that window are not accepted through the website and may be arranged by telephone or WhatsApp at the Company's discretion, subject to availability.
- You warrant that all information provided at the time of booking — including venue address, guest count, and any legal authorization required to host the event at the stated venue — is true, complete, and accurate, and you accept sole responsibility for any loss arising from inaccurate or incomplete information.
4. Fees and Payment
- Prices are quoted in AED and include applicable VAT unless stated otherwise.
- A deposit of fifty per cent (50%) of the total is required to secure your booking. The treatment of the deposit on cancellation is set out in Section 5.
- The remaining fifty per cent (50%) is due within twenty-four (24) hours of the start of the event, and in all cases must be settled in full before the event begins.
- Accepted payment methods: bank transfer, which is the Company's preferred method. Cash may be accepted at the Company's discretion and is agreed with the Client on a case-by-case basis before the event.
- Transport fee. A transport fee applies to occasions outside Abu Dhabi and reflects the movement of crew and equipment to your venue. It is charged in addition to the package price and is not included in it: Abu Dhabi free, Dubai 150, Al Ain 150, Sharjah 200, Ajman 250, Ras Al Khaimah 300, Umm Al Quwain 300, Fujairah 350, in AED, VAT inclusive. Hospitality boxes are subject to a separate transport schedule, quoted at the time of order.
- Additional charges (extra Staff, extended hours, additional menu items, last-minute changes, or guest numbers exceeding the confirmed count) will be notified before being applied and are payable immediately upon notice.
- Any chargeback, payment reversal, or dispute initiated in relation to services that have already been rendered in accordance with the confirmed booking shall be deemed made in bad faith, and the Client agrees to indemnify the Company for all costs, including administrative and legal fees, incurred in contesting such action.
5. Cancellation and Rescheduling Policy
- Cancellations made forty-eight (48) hours or more before the start of the event: the deposit is held as credit against a future booking, which is the Company's normal practice. Where the Client asks instead for the deposit to be returned, the Company will consider the request having regard to any costs already incurred, and any sum due is paid within fourteen (14) business days.
- Cancellations made within forty-eight (48) hours of the start of the event: the Client must notify the Company by WhatsApp as early as possible. Costs already incurred on the Client's behalf — including ingredients purchased, items printed or bought specifically for the event, crew scheduling and transport — are borne by the Client and are deducted before any sum is returned. Whether any balance is returned, and how much, is at the Company's sole discretion. The Company will set out what was incurred and pay any balance due within fourteen (14) business days.
- Rescheduling is subject to crew and cook availability and must be requested at least forty-eight (48) hours in advance; the Company shall use reasonable commercial efforts to accommodate such requests but does not guarantee availability. Where plans change, the Company will where possible move the date or hold the booking for another, subject to availability.
- The Company reserves the right to cancel or reschedule a booking due to circumstances beyond its reasonable control (see Force Majeure), in which case the Client shall be offered, at the Company's discretion, a full refund or an alternative date.
6. Client Responsibilities and Warranties
You represent and warrant that you:
- Have full legal authority to book the event at the stated venue and have obtained all necessary permissions, licenses, and consents (including from the venue owner/management) required for the Company's Staff to perform services there.
- Will provide accurate and complete event details, including guest count and all known dietary restrictions or allergies, in writing and no later than forty-eight (48) hours before the event.
- Will ensure safe, lawful, and reasonable access to the venue, including kitchen, water, electrical, and any other facilities reasonably required by the Staff.
- Will not use the Company's services, directly or indirectly, in furtherance of any unlawful, fraudulent, defamatory, or otherwise improper purpose.
- Will ensure that guests treat Staff with respect and dignity. The Company reserves the right, without liability or refund obligation, to withdraw any or all Staff from an event where they are subjected to abusive, discriminatory, violent, or unsafe treatment.
7. Food Safety and Allergies
- The Company's chefs exercise reasonable skill, care, and hygiene in food preparation in accordance with applicable UAE food safety standards.
- Notwithstanding the foregoing, the Client acknowledges that no food preparation environment can be guaranteed entirely free of allergens or cross-contamination risk, particularly at third-party or shared venues, and that the Company's liability in this respect is strictly limited to instances of proven gross negligence.
- The Client is solely responsible for disclosing, in writing, all known allergies, intolerances, and dietary restrictions among guests prior to the event. Failure to disclose shall relieve the Company of liability for any resulting adverse reaction, to the fullest extent permitted by law.
- Specific certifications (halal, vegetarian, vegan, etc.) must be requested at booking and are subject to written confirmation.
8. Staff Conduct, Supervision, and Non-Circumvention
- Staff shall conduct themselves professionally and perform only the duties within the agreed scope of service. Staff are not authorized to undertake childcare, security, transport, or any duties outside that scope absent separate written agreement.
- Non-Circumvention. In consideration of the Company's investment in recruiting, vetting, and training its Staff, the Client agrees that it shall not, whether directly or indirectly, and whether during the term of any engagement or within a period of twelve (12) months thereafter, solicit, engage, employ, subcontract, or otherwise procure the services of any Staff member introduced to the Client by the Company, other than through the Company. Any breach of this clause shall entitle the Company, without prejudice to any other remedy available at law, to a placement/referral fee of AED 15,000 (a fixed sum or a percentage of the relevant Staff member's first twelve (12) months' remuneration from the Client, whichever is greater), which the parties agree represents a genuine pre-estimate of the Company's loss and not a penalty.
- A supervisor or team lead may be assigned for larger events; their contact details will be shared at booking.
9. Complaints and Claims Notification
Any complaint, dispute, or claim relating to the quality, conduct, or performance of the services must be notified to the Company in writing within forty-eight (48) hours of the conclusion of the event. Claims notified outside this window shall be deemed waived, save where the Client can demonstrate that timely notification was not reasonably possible.
10. Right to Refuse, Suspend, or Terminate Service
The Company reserves the right, at its sole and absolute discretion and without liability or obligation to refund, to refuse, suspend, or terminate the provision of services, in whole or in part, before or during an event, where:
- the Client or its guests engage in unlawful, abusive, violent, or unsafe conduct;
- payment due under these Terms has not been received;
- the venue presents, in the Company's reasonable judgment, a health, safety, or security risk to Staff; or
- the Client has materially misrepresented information relevant to the booking.
11. Media, Photography, and Marketing Rights
The Company does not photograph or record any event unless the Client has given prior written consent. Where such consent is given, it is limited to the material and purposes described in the consent, may be withdrawn by the Client at any time before publication, and grants the Company a non-exclusive, royalty-free licence to use that material for portfolio, marketing and promotional purposes.
The following are never photographed or recorded, and no consent will be sought or accepted in respect of them:
- the women's majlis, in any circumstances;
- a condolence majlis, in any circumstances;
- any guest who has indicated that they do not wish to be recorded.
Where consent has been given, the Client remains responsible for informing their own guests. Crew are instructed that the absence of explicit consent means no recording.
12. Third-Party Vendors and Venues
Where the Client engages additional third-party vendors, suppliers, or venues in connection with the event, the Company shall have no liability whatsoever for the acts, omissions, quality, or conduct of such third parties, whether or not recommended or referred by the Company.
13. Limitation of Liability
To the fullest extent permitted under the laws of the United Arab Emirates:
- The Company's aggregate liability arising out of or in connection with these Terms or the services, whether in contract, tort, or otherwise, shall not exceed the total fees actually paid by the Client for the specific booking giving rise to the claim.
- In no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profit, loss of business, loss of goodwill, loss of enjoyment, or loss of data, even where the Company has been advised of the possibility of such damages.
- Nothing in these Terms shall exclude or limit liability for death, personal injury caused by proven gross negligence, fraud, or any other liability that cannot lawfully be excluded or limited under UAE law.
14. Indemnification
The Client agrees to indemnify, defend, and hold harmless the Company, its owners, employees, and Staff from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) the Client's breach of these Terms; (b) inaccurate, incomplete, or misleading information provided by the Client; (c) the acts or omissions of the Client's guests or invitees; or (d) any unsafe, unlawful, or non-compliant condition of the venue not caused by the Company.
15. Force Majeure
The Company shall not be liable for any delay, failure, or inability to perform its obligations arising from causes beyond its reasonable control, including without limitation acts of God, natural disasters, extreme weather, fire, epidemic or pandemic, governmental action or restriction, public health emergency, civil unrest, strikes, cyberattack, utility or supply-chain failure, or denial of venue access.
16. Intellectual Property
All branding, trade names, menus, recipes, presentation formats, and marketing or promotional content created by the Company remain the sole intellectual property of Yafnah and Co and may not be copied, reproduced, or used without prior written consent.
17. Dispute Resolution and Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. The parties shall first attempt in good faith to resolve any dispute through informal negotiation for a period of not less than fifteen (15) business days. Failing resolution, the dispute shall be submitted to the exclusive jurisdiction of the courts of the Emirate of Abu Dhabi, United Arab Emirates.
18. Entire Agreement; Severability; Waiver
- Entire Agreement. These Terms, together with the applicable booking confirmation, constitute the entire agreement between the parties and supersede all prior oral or written representations, negotiations, or understandings relating to the subject matter herein.
- Severability. If any provision of these Terms is held invalid or unenforceable by a competent authority, that provision shall be modified to the minimum extent necessary to render it enforceable, and the remaining provisions shall continue in full force and effect.
- Waiver. No failure or delay by the Company in exercising any right under these Terms shall operate as a waiver of that right, nor shall any single or partial exercise preclude any further exercise of that or any other right.
19. Assignment and Subcontracting
The Company may assign its rights or subcontract its obligations under these Terms, in whole or in part, without the Client's consent, provided that the Company remains responsible for the performance of any subcontractor. The Client may not assign or transfer its rights or obligations under these Terms without the Company's prior written consent.
20. Notices
Any notice required under these Terms shall be given in writing and delivered by email to the address specified in the booking confirmation, and shall be deemed received twenty-four (24) hours after transmission unless the sender receives notice that the email was not delivered.
21. Language of these Terms
These Terms are provided in both English and Arabic for the Client's convenience. In the event of any conflict or inconsistency between the two versions, the Arabic version shall prevail, save where mandatory UAE law requires otherwise.
22. Amendments
The Company may update these Terms from time to time by posting the revised version on this page with an updated "Last Updated" date. Continued use of the Company's services following any such change constitutes acceptance of the amended Terms.
